User Content, AI Outputs & Virtual Credits

1. User Content

You may upload content to the Services, including images, prompts, text, and other materials (“User Content”). You retain ownership of any intellectual property rights you hold in your User Content.

By uploading or submitting User Content to the Services, you grant Ether Studio a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify (for technical purposes), and display such User Content solely for the purpose of operating, providing, and improving the Services.

You represent and warrant that:

  • You own or have all necessary rights, licenses, and permissions to upload and use the User Content;
  • Your User Content does not infringe or violate any third-party rights, including intellectual property, privacy, publicity, or contractual rights;
  • Your User Content does not contain illegal, harmful, defamatory, abusive, hateful, or sexually explicit material;
  • Your User Content does not depict minors in any sexual or exploitative context;
  • Your User Content complies with all applicable laws and regulations.

You are solely responsible for your User Content and any consequences arising from its upload, generation, sharing, or distribution.

2. AI-Generated Outputs

The Services use artificial intelligence models to generate images and other content (“Outputs”) based on user inputs.

You are responsible for reviewing all Outputs before using, publishing, or distributing them.

Ether Studio does not guarantee that Outputs:

  • Are original;
  • Do not infringe third-party intellectual property rights;
  • Are accurate, reliable, or error-free;
  • Are suitable for any particular purpose.

Outputs are provided “as is” and “as available.” You assume all risks associated with the use of Outputs.

The Services integrate third-party AI models (including but not limited to Flux, Kling, Veo, and others). Your use of Outputs may also be subject to the terms of the respective model providers. Ether Studio is not responsible for the outputs of third-party models.

3. Public Sharing & Gallery

Content you choose to make public through the gallery or other sharing features will be visible to other users and potentially the public.

By making content public, you grant Ether Studio the right to display, reproduce, and promote such content within the Services and in marketing materials related to the Services.

Ether Studio reserves the right, but not the obligation, to remove any public content at its sole discretion.

All generated content is private by default. You are solely responsible for choosing to make content public.

4. Prohibited Uses

You agree not to use the Services to:

  • Generate or distribute sexually explicit or pornographic material;
  • Generate content involving minors in any sexual, exploitative, or inappropriate manner;
  • Infringe intellectual property rights;
  • Impersonate any person or entity;
  • Harass, threaten, or harm others;
  • Upload illegal or malicious content;
  • Attempt to reverse engineer, disrupt, or exploit the Services.

Ether Studio may suspend or terminate accounts that violate these restrictions.

5. Content Moderation & Removal

Ether Studio reserves the right, but not the obligation, to monitor, review, remove, or restrict access to any User Content or Outputs at its sole discretion.

We may suspend or terminate accounts that violate these Terms.

6. Virtual Credits

The Services operate on a virtual credit system. Credits:

  • Have no monetary value;
  • Are non-transferable;
  • Are not legal tender;
  • Are non-refundable except where required by law.

Ether Studio may modify credit pricing, expiration terms, or usage rules at any time.

Credits may be revoked in cases of fraud, abuse, chargebacks, or violations of these Terms.

7. Indemnification

You agree to indemnify, defend, and hold harmless Rahul Duggal, doing business as Ether Studio, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of:

  • Your User Content;
  • Your use of AI-generated Outputs;
  • Your violation of these Terms;
  • Your infringement of any third-party rights.
